Terms of Service

By accessing or using Phumi Music ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Phumi Music Ltd.

Phumi Music provides a music distribution platform that allows artists, bands, and rights holders to distribute their original music to digital streaming platforms and online stores worldwide. Our services include, but are not limited to:

• Digital music distribution to 50+ streaming platforms and stores
• ISRC and UPC code generation
• Royalty collection and reporting
• Real-time analytics and stream tracking
• Artist dashboard and release management tools

To use Phumi Music, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. If you are under 18, you may only use the Platform with parental or guardian consent.

You retain 100% ownership and copyright of all music and content you upload to Phumi Music. By uploading content, you grant Phumi Music a non-exclusive, worldwide, royalty-free license to distribute, reproduce, and deliver your content to third-party platforms as directed by you.

You represent and warrant that you own or have the necessary rights to all content you upload, and that such content does not infringe any third-party intellectual property rights.

Phumi Music collects royalties from digital streaming platforms on your behalf and passes 100% of net royalties to you. "Net royalties" refers to the amounts received by Phumi Music from DSPs after their own deductions.

• Royalty payments are processed monthly for the prior month's earnings
• A minimum payout threshold of $10 USD applies
• Payments are made via bank transfer or PayPal
• Phumi Music is not responsible for delays caused by DSPs or payment processors

You may not upload content that:

• Infringes any copyright, trademark, or intellectual property rights
• Contains hate speech, discrimination, or content promoting violence
• Is fraudulent, deceptive, or misleading
• Violates any applicable laws or regulations
• Contains samples or interpolations without proper clearance
• Is generated entirely by AI without significant human creative input (subject to platform-specific guidelines)

Either party may terminate this agreement at any time. You may close your account via your dashboard settings. Phumi Music reserves the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Platform.

Upon termination, your releases will be removed from stores within 24–72 hours. Any outstanding royalties owed to you will be paid out within 30 days of termination.

Phumi Music is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Phumi Music shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, loss of data, or service interruptions.

Phumi Music reserves the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the Platform. Your continued use of the Platform following such notice constitutes your acceptance of the updated Terms.
